Privacy Notice pursuant to Article 13 of EU Regulation 2016/679 Information notice for the processing of personal data collected from the data subject

In this document, our organization Imoon s.r.l. (hereinafter "Imoon") provides the Representatives of companies coming into contact with Imoon (hereinafter: "Representatives") with an overview of how their data is processed and their rights under EU Regulation 2016/679 (GDPR). This notice is not to be considered valid for other websites that may be accessible through links on the internet sites under the owner's domain; the owner shall not be held responsible in any way for third-party websites. This information is provided pursuant to Article 13 of EU Regulation 2016/679 (European General Data Protection Regulation) and is also inspired by the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC, regarding Cookies, as well as the provisions of the Italian Data Protection Authority (Garante per la protezione dei dati personali) Measure of 08.05.2014 regarding cookies.

Categories of Personal Data

Imoon processes personal identification and non-sensitive data (hereinafter "personal data") for the management of business relationships, to satisfy a legitimate interest, for the performance of a contract, and to comply with legal obligations.
The personal data being processed includes, for example, personal identification data, company identification data, and contact details. The data is collected directly by Imoon.
In accordance with Articles 9 and 10 of GDPR 2016/679, you may provide data classified as "special categories of personal data" (i.e., data revealing "racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership... genetic data, biometric data intended to uniquely identify a natural person, data concerning health or a person's sex life or sexual orientation, or data relating to criminal convictions and offences").
These categories of data may only be processed by Imoon with your prior express written consent, provided by signing this information notice.

1A. DATA CONTROLLER, Pursuant to Articles 4 and 24 of the GDPR, the Data Controller is Imoon S.r.l., with registered office in Via Imperia 2, 20142 Milan (MI), Italy, in the person of its pro-tempore legal representative. The contact email for the Data Controller is: privacy@imoon.it

1C. PURPOSES AND LEGAL BASIS FOR PROCES
The personal data provided will be processed in compliance with the conditions of lawfulness pursuant to Art. 6(f) of EU Regulation 2016/679 and are necessary for the following purposes:

- Completion of website registration forms to access Imoon services;
- Completion of data collection forms, login, and/or contact requests for the provision of requested information;
- Completion of data collection forms for internal personnel recruitment;
- Completion of data collection forms for receiving newsletters or promotional communications directly from Imoon, generally via email;
- Administrative and accounting purposes for invoicing and payments;
- Drafting of quotes or requests for proposals.

Data may be processed in hard copy, electronic, and/or automated formats.

1D. Data processing is based on Article 6(1)(f): (Recital 47), taking into account the reasonable expectations of the data subject at the time and within the context of the collection of personal data, when the data subject can reasonably expect that processing for this purpose may take place. For specific marketing activities, the legal basis will be consent.
Pursuant to Art. 6(b), data will be processed without consent in the event of:
– Execution of contracts related to products or services;
– Compliance with pre-contractual, contractual, and tax obligations;– Compliance with obligations provided for by Law or by an order of an Authority;
– The necessity to exercise Imoon's rights (e.g., in legal proceedings).

For existing customers already present in our management systems, we may send commercial communications similar to those already received, unless you explicitly object. Such objection must be sent via email to privacy@imoon.it

1E. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF DATA
The data will not be disseminated and will only be processed by those who need access to the data to fulfill their contractual and legal obligations and to protect legitimate interests. The list of Data Processors is constantly updated and available by writing to  privacy@imoon.it or at Imoon's registered office in Via Imperia 2, 20142 Milan (MI)

1F. DATA TRANSFER TO A THIRD COUNTRY AND/OR INTERNATIONAL ORGANIZATION AND SAFEGUARDS
Personal data will not be transferred to EU Member States or third countries outside the EU without your explicit consent, except for communications necessary for the fulfillment of legal obligations (Art. 2.A).

2A. DATA RETENTION PERIOD OR CRITERIA FOR DETERMINATION
Processing will be carried out in automated and manual forms, with methods and tools aimed at ensuring maximum security and confidentiality, by specifically authorized persons. In compliance with Art. 5(1)(e) of EU Regulation 2016/679, personal data collected will be stored in a form that allows the identification of data subjects for a period of time not exceeding the achievement of the purposes for which the personal data are processed.

2B. RIGHTS OF THE DATA SUBJECTS
You may assert your rights as expressed in EU Regulation 2016/679 by sending an email to  privacy@imoon.it  or by writing to the Controller's office indicated above. You have the right, at any time, to request information on the presence of and access to your personal data (Art. 15), its rectification (Art. 16), its erasure (Art. 17), the restriction of processing (Art. 18), or to object to its processing based on legitimate interest (Art. 21). Finally – if applicable – you have the right to data portability (Art. 20).

2C.You have the right to lodge a complaint with a competent supervisory authority.

2D. The communication of personal data is not an obligation. You are free to provide personal data in the dedicated areas of the website. Failure to provide personal data makes it impossible to use the services offered by the Data Controller.

CHANGES TO THE PRIVACY POLICY

The Controller reserves the right to modify, update, add, or remove parts of this privacy policy at its discretion and at any time. The data subject is required to periodically check this page for any changes.
